1. About Dily
Dily is a podcast player app that allows users to subscribe to podcasts, view the latest episodes, follow other users, and like podcasts that may be recommended to followers.
Dily indexes and plays podcast content from third-party podcast feeds. Dily does not create, own, or control the podcast content available through those feeds.
2. Eligibility
You must be at least 13 years old to use Dily.
If the law in your country requires you to be older to use online services or consent to data processing, you must meet that minimum age.
By using Dily, you confirm that you meet these requirements.
3. Accounts
You may sign in to Dily using Google or Apple.
You are responsible for keeping your account secure and for all activity that occurs under your account. You must not use another person's account without permission or provide false, misleading, or impersonating account information.
You may delete your profile from within the app.
4. Usernames, Avatars, Follows, and Likes
Dily allows you to set a username, upload an avatar, follow other users, and like podcasts.
You are responsible for any username, avatar, or activity associated with your account. You must not use Dily to upload, display, or share anything that is unlawful, abusive, harassing, hateful, misleading, defamatory, obscene, infringing, spammy, or impersonates another person or brand.
Podcast likes may be shown or recommended to users who follow you.
5. Moderation and Account Action
We may remove usernames, avatars, follows, likes, or other account activity if we believe they breach these Terms, create risk for Dily or other users, or are otherwise inappropriate.
We may suspend or terminate your account if you misuse Dily, breach these Terms, violate the law, interfere with the app, attempt unauthorized access, abuse other users, or create risk for Dily.
6. Podcast Content
Podcast content available through Dily is provided by third-party podcast creators, publishers, and feed providers.
We are not responsible for the accuracy, availability, legality, quality, or content of third-party podcasts. Podcast feeds may change, become unavailable, include errors, or be removed without notice.

7. Third-Party Services
Dily may use third-party services to operate the app, including Apple, Google, Supabase, Firebase, Expo, PostHog, and third-party podcast feed providers.
Your use of those services may also be subject to their own terms, policies, and technical requirements.
8. Notifications and Communications
If you enable push notifications, Dily may send notifications about new episodes, recommendations, followers, likes, and app updates.
If your account provides an email address, we may send you account-related messages, product updates, recommendations, security notices, and other communications related to Dily.
You can control push notifications through your device settings.
9. Future Paid Features
Dily is currently free to use.
In the future, Dily may offer paid features, subscriptions, or other paid services. If we introduce paid features, the applicable price, billing terms, renewal terms, and cancellation information will be shown before purchase.
For purchases made through the Apple App Store, payment and subscription management will be handled by Apple under Apple's terms and policies.
10. Changes to Dily
We may update, change, suspend, remove, or discontinue any part of Dily at any time. We may also impose limits on certain features or restrict access to parts of the app where needed.
We will try to avoid unnecessary disruption, but we do not guarantee that Dily will always be available, uninterrupted, or error-free.
11. Privacy
Your use of Dily is also governed by our Privacy Policy, which explains how we collect, use, and protect personal information.
12. Acceptable Use
You must not:
- Use Dily for unlawful, harmful, abusive, or fraudulent purposes.
- Attempt to access accounts, systems, data, or features without permission.
- Interfere with or disrupt Dily's operation.
- Scrape, copy, or harvest data from Dily except as permitted by law.
- Reverse engineer, modify, or create derivative works from Dily except as permitted by law.
- Upload malicious code or attempt to compromise security.
- Use Dily to impersonate another person or organization.
- Use Dily in a way that infringes another person's rights.
13. Intellectual Property
Dily, including its name, design, software, features, branding, and related materials, is owned by Thomas Barnett or licensed to us.
You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from Dily except as allowed by these Terms or applicable law.
Third-party podcast content remains owned by its respective creators, publishers, or rights holders.
14. Disclaimer
Dily is provided on an "as is" and "as available" basis.
To the maximum extent permitted by law, we do not make warranties or guarantees that Dily will be uninterrupted, secure, error-free, accurate, or suitable for your particular needs.
We do not endorse or guarantee any third-party podcast content available through Dily.
15. Limitation of Liability
To the maximum extent permitted by law, Thomas Barnett will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from your use of Dily.
Nothing in these Terms excludes, restricts, or modifies any rights you may have under laws that cannot legally be excluded, including applicable consumer protection laws.
16. Indemnity
You agree to indemnify and hold harmless Thomas Barnett from claims, losses, damages, liabilities, costs, and expenses arising from your misuse of Dily, breach of these Terms, violation of law, or infringement of another person's rights.
17. Termination
You may stop using Dily at any time and may delete your profile within the app.
We may suspend or terminate your access to Dily if you breach these Terms, misuse the app, create risk for other users or Dily, or where required by law.
18. Governing Law
These Terms are governed by the laws of Victoria, Australia.
You and Thomas Barnett submit to the courts of Victoria, Australia, except where applicable consumer laws in your country give you rights to bring claims elsewhere.
19. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we may notify you in the app, by email, or by other appropriate means.
Your continued use of Dily after the updated Terms take effect means you accept the updated Terms.
